Marlon Ybarra Killed, Whittany Sutton Injured in Car Accident on Nasa Pkwy in El Lago, TX

UPDATE (June 10, 2022): Sources have identified the Toyota Camry passenger injured in this accident as 31-year-old Whittany Sutton.

El Lago, TX — May 15, 2022, 30-year-old Marlon Ybarra died and two people were seriously injured in a traffic accident on Nasa Parkway in El Lago.

Authorities say the incident happened around 2:20 a.m. on Nasa Parkway near Kirby Road. Preliminary investigation suggests a GMC Sierra pickup truck was headed east on the roadway as Ybarra drove a Toyota Camry west on the other side.

According to reports the pickup driver failed to maintain his lane and veered through the median into the oncoming lane. The pickup then crashed with the Camry.

Ybarra suffered fatal injuries in the crash. A passenger in the Camry and the pickup driver received serious injuries.

Investigators noted that the GMC driver may have been under the influence of alcohol or might have fallen asleep before crossing over.

It's always concerning when investigators mention that alcohol may have played a role in a crash. To be clear it's only a theory unless they found specific evidence, but looking into that possibility is important for a number of reasons. Obviously it's dangerous for anyone to drive drunk, but beyond that a local business may have broken the law by selling or serving too many drinks to its customer.

That's dealt with by dram shop law, which says any business that illegally over-serves its customers may be liable for the damage they cause or suffer while drunk. In the El Lago crash, for example, any business that over-served the crossover driver might have a duty to help him, the injured passenger from the other car, and the other driver's family recover from this devastating accident.

With all that said, I repeat that intoxication is only a theory at this time. Sometimes police find clear proof of it at the scene, but other times they just guess based on what happened. It's unclear whether they took any steps to verify their belief, but even if they did it's important to give everyone the benefit of the doubt unless clear evidence says otherwise. If the facts ultimately point to impairment then there may be further considerations, but right now it's best to focus on how the people hurt in this crash can be helped.

Dram shop law was created to ensure negligent over-service is met with appropriate consequences. Not every DWI wreck starts with a dram violation, but they're more common than many people think and they should be dealt with swiftly if a bar is endangering the community. So will the authorities look into the possibility of such a violation here, or would an independent investigation better help the victim get the help and justice she deserves?
