Commentary on Glenn Heights Man Truck Accident on Goodnight Lane in Dallas
A situation like this can be very complex because, if the reports are accurate, there was someone in a dangerous place where they shouldn't have been. It's entirely possible this truck driver was just in the wrong place at the wrong time. But reconstructing the exact circumstances is crucial in these situations. Just because someone is in the road when they shouldn't be doesn't give drivers carte blanche to hit them.
If investigations show that the truck driver either didn't give enough room to the pedestrian or otherwise was not reasonable in deciding it was safe to pass, then there may need to be further investigations into whether or not all of this was actually avoidable. A truck driver that fails to avoid otherwise avoidable collisions can be held responsible depending on what kept them from behaving as a reasonably prudent professional should.
Like I said, though, the evidence could show this truck driver had no control over the situation. It would be ludicrous to hold someone accountable for something they couldn't possible avoid. That's why it's important to ensure there are thorough investigations so the victim's loved ones at least know they're getting all the facts.
