Commentary on Juan Jose Velazquez Truck Accident in Harris County
As straight-forward as these reports may seem, one of the biggest mistakes I see from inexperienced attorneys is treating a seemingly straight-forward crash as no big deal. That's a good way to let insurance companies have their way with the facts and cheat victims and families out of the help they deserve. Even crashes like this can be incredibly complex when taken too lightly.
Not long ago, for example, I handled a situation in which a truck cut someone off and caused a deadly wreck. To avoid responsibility, they claimed that the victim had been speeding and not wearing their seatbelt. We knew this was a ridiculous defense, but any defense left unchallenged can find footing. We got to work picking their defense apart.
One thing that helped was markings at the scene and a frozen speedometer showing definitively that the driver hadn't been speeding. Additional, the emergency responders from the scene all testified they actually had to cut through the victim's seatbelt just to get them out of the vehicle. And top all that off, our investigations showed the reflective tape on the truck's trailer was so caked in dirt that it was practically invisible.
It was only after exhaustive investigations that the trucking company finally relented and did right by the victim's loved ones. That's almost always the hill that families must climb after serious truck wrecks. As such, ensuring there are thorough investigations from experienced professionals is almost always crucial for getting people the answers and the help they deserve. Are those steps being taken here?
