Commentary on Tractor-Trailer Accident on I-94 near Parma in Jackson County

When people read about crashes like this one, they often think that the path forward is no big deal. Police say a truck ran into slowing traffic. That's about as open-and-shut as it gets, right? Well, not when the investigations are done properly. Not only do they need to consider uncommon situations a truck driver can't avoid (mechanical defects, for example), but they also need to consider the possible factors leading to a truck driver's mistake.

Here's what I mean by that. A crash I handled a while back happened because a truck driver had a medical emergency. Oftentimes, that's simply unavoidable, and no one can really be blamed. That's certainly how the trucking company saw it, but we still made sure to be thorough in our investigations. What we ultimately found was that the trucking company very much could have seen the crash coming.

This was due to the driver's medical history being a long list of red flags that any halfway decent trucking company should have caught onto. The issues were such that it was clearly just a matter of time before the truck driver's various conditions got himself or someone else seriously hurt. That's exactly what happened. Either that company knew about the issues and did nothing to avoid them, or they were so inept they didn't consider the risk. It's hard to say which would be worse.

I'm not saying anything like that happened here, but it's one of the many examples throughout my career where a seemingly straight-forward situation turned out to be anything but once there were more thorough independent investigations. The same could prove true here, which is why it's often worth the effort to make sure complex truck wrecks like this get attention from independent professionals as soon as possible.
