Three Injured by Hit-and-Run Driver at Loop 410 and Fredericksburg Rd in San Antonio, TX

San Antonio, TX -- May 13, 2022, three people were injured in a hit-and-run collision on the Loop 410 access road in San Antonio.

Authorities say the incident happened around 11:30 p.m. on the Loop access road at Fredericksburg Road. Preliminary investigation suggests a Ford Mustang was headed north on Fredericksburg when the driver allegedly ran a red light and crashed into a westbound Ford Edge. The Mustang then fled the scene without stopping or rendering aid.

The Edge's occupants--a 56-year-old man and two teenagers--were injured in the crash.

Police were able to track the Mustang driver to their residence and arrested them on a charge of failure to stop and render aid.

The investigation is ongoing. No further information is available at this time.

A common error I see after these incidents is thinking preliminary reports include everything there is to know. The suspect allegedly fled after hurting the victims and then got caught and charged, so what more could there be to say?

For starters, there's the urgent question of why the suspect left after the crash. What would compel someone to do that? Did they just panic, or were they trying to hide something else? Learning the answer to that is more important than some may realize. Depending on why the suspect took off, there may unique legal avenues to help the victims get back on their feet. Most would agree it's best to make sure they get all the help they deserve.

So what do I mean by "trying to hide something else?" Well, for one, the possibility that a hit-and-run suspect was intoxicated at the time usually warrants careful investigation. Many drivers flee because their judgment is clouded by alcohol. If that turns out to be a factor in the above accident, that could mean a local alcohol provider is partly responsible for the victims' injuries under dram shop law. In that case the business might have a legal obligation to help the victims get back on their feet.

I'm not saying for certain that a dram shop violation happened here, but did the authorities even look into it? I hate to say it, but probably not. Law enforcement doesn't spend much time tracking down negligent over-service from bars and other vendors, content instead just to catch and punish drunk drivers. It's only right that they face consequences, but the idea that police might let another responsible party slip away is frustrating. That's why dram shop matters are most often dealt with by independent investigators. Their careful attention to detail may be a step toward getting the victims some much-needed assistance in a tough time.
