Roseanna Martinez Killed in Alleged Intoxicated Driver Accident in San Juan, TX

San Juan, TX -- April 16, 2022, Roseanna Martinez was killed due to an accident where an allegedly intoxicated driver hit her.

Investigators reported that the crash took place at around 1:30 a.m. along Carroll Road near the intersection of Stewart Road.

According to officials, 32-year-old Roseanna Martinez was walking along East Carroll at the time. In a series of events not entirely clear, a westbound vehicle hit Martinez in the roadway.

Roseanna Martinez reportedly succumbed to fatal injuries due to the collision. The driver was identified in reports as Michael Martinez. Authorities said that alcohol may have been a factor in the accident, and Michael Martinez may face intoxication manslaughter charges. This and other details remain unconfirmed at this time.

Just to be clear up front, it's not my place to say what did or didn't happen here, and I certainly won't confirm or deny any of the allegations made in the reports. That's all something that requires far more thorough investigations. The reason I want to comment on this tragic event is because there are often unique factors surrounding alleged intoxicated driving accidents which authorities rarely address on their own. The public deserves to be as informed as possible, which is why it's important to discuss how dram shop law can apply to situations like the one described here.

To put it simply, dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication.
