Commentary on Sergio Campo Accident off I-45 in Montgomery County
It's obviously serious any time police mention alcohol, but they appear to be taking steps to ensure there are consequences for what happened here. But does arresting a drunk driver really do much for the injured victim? Holding people accountable for bad choices is important, but it doesn't do a lot for someone who has to deal with the fallout of a hospital visit. That's why it's important to understand the possible legal avenues victims and families can use after these wrecks to get the help they need.
For example, if it's true that alcohol was a factor here then where did the drinks come from? If alcohol providers over-serve someone who is obviously intoxicated, they can be liable for any damage that person causes under dram shop law. It's a crucial tool for victims and families to get the help they need while also making sure negligent alcohol providers (that would otherwise benefit from their recklessness) face appropriate consequences.
Nobody can say at this point whether a dram shop violation happened before this crash, but it's important that investigators look into any possible way to get the victim the help he needs and deserves. Are police taking the necessary steps here, or would independent experts be of more help?
