Commentary on Houston Man Truck Accident on Sam Houston Parkway in Pasadena

With crashes like this, it's too easy for people to assume they're open-and-shut. Quite frankly, a truck driver rear-ending traffic is almost always a sign they were being negligent. While it is important to consider the possibility they couldn't avoid whatever led to the crash, it's also important make sure there is clear evidence to actually show what happened. Doing so can be pivotal in getting people the help they need.

Case in point, I handled a situation not long ago where a truck, clearly distracted, crashed into a vehicle, seriously injuring someone. As clear as the facts seemed, the trucking company was denying responsibility. In fact, they even denied that their driver owned a phone. That sure didn't pass the smell test, but it took us putting the driver through a lengthy deposition and tripping him up in his own stories to get him to admit that he did indeed own a phone. Only after that were we able to get a court order for the records, showing the driver was busy watching pornography at the time of the crash.

I'm not saying anything so ridiculous happened here, but I can't count how many times victims and families sat on what they believed to be an open-and-shut report only to find they came up short against the countless defense tactics companies have at their disposal. Having the tools and experience to anticipate these tactics is crucial for anyone in need of help.
