Commentary on Truck Accident on State Route 31 in Charlotte County

Something I try to emphasize to folks is the importance of taking preliminary reports with a grain of salt. They aren't always as thorough or accurate as they may seem. I see a few reports on this crash which suggest the car swerved over the center line. That could happen for many reasons. While things relating to reckless driving are more common, one shouldn't rule out things like medical conditions, mechanical defects, or even road hazards without clear evidence. But that's only if these preliminary reports are accurate.

Just to be clear, I'm not saying this to muddy the waters. I wouldn't be so cautious if 30 years of experience and hundreds of commercial vehicle wrecks didn't teach me the importance of withholding judgments until all the facts are clear.

Not long ago, for example, I handled a crossover wreck where authorities said a car veered over the center line and hit an 18-wheeler. When we actually put the evidence together, however, it turned out police completely got the facts wrong. It was actually the 18-wheeler that drifted to the left, causing the victim to swerve to their left to avoid the collision. The 18-wheeler then veered back to the right where the vehicles crashed head-on.

Had there not been more thorough independent investigations, that family may never have learned the truth about that fatal crash. Now, there are plenty of examples where further investigations confirm exactly what authorities already know. There are investigations that show police are on the right track, but there are extenuating circumstances they overlooked. The key is simply to be sure folks have all the tools and evidence they need to move forward. Are those steps being taken here?
