Commentary on Myron Liggins Alleged Intoxicated driver Accident in San Marcos

It's not my place to say whether or not these allegations are true, but intoxicated driving accidents are all too common this early in the morning. A big reason for that is simply that many people are on their way home from local bars. This is actually a crucial detail for investigators to consider. An intoxicated driver is not always the only party responsible for a deadly wreck. Families also deserve any possible opportunity to confront the alcohol provider that contributed to that fatal crash.

While it may sound odd to bring a business into a crash like this, it has to do with Texas dram shop law. Essentially, the law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. If some local bar recklessly over-serves its customers, it's putting lives at risk and breaking the law. So why should they get off scot-free while a driver faces potentially decades in prison and a family faces a lifetime without their loved one?

Dram shop is a legal remedy that seeks to answer that. Not only can it give folks some much needed help, it can also provide an opportunity to confront a negligent business that cares more about its sales than the safety of their community and even their own customers. Like I said, it's not my place to say if anything like that happened here. That would require a closer look at the evidence. My point is simply that having an experienced professional take that closer look is crucial for ensuring that folks at least know they're getting the full story. Especially if that shows there's an accomplice to these tragic events, it's the least one can do for a grieving family.
