Commentary on Pedestrian Garbage Truck Accident on Yosemite in Manteca
There isn't much information about what happened here, but folks tend to assume that either the pedestrian was in a crosswalk, or they were in the wrong. As important as right-of-way is, things aren't really that simple. Especially in California, where people are generally on the hook for their portion of the blame, however little, it's crucial to consider everyone's actions. For example, if someone is in the middle of the road, and it's too dark to see them, a driver may not be able to avoid them. However, if they're clearly visible and reasonably avoidable, a driver failing to avoid them would be a serious red flag. Are investigators considering these possibilities thoroughly?
