Kyle Garrett Injured in Single-Vehicle Accident on US-84 in Limestone County, TX

Limestone County, TX -- April 9, 2022, 27-year-old Kyle Garrett was seriously injured in a single-vehicle accident on U.S. Highway 84 in Limestone County.

Authorities say the incident happened around 2:15 a.m. on US-84 near County Road 312. Preliminary investigation suggests Garrett was driving a Toyota Tundra pickup truck east on the highway when he reportedly failed to maintain a single lane and drove on to the shoulder. The pickup hit the guardrail, then flipped over into the nearby bar ditch. It rolled until it came to rest on its passenger side south of the highway.

Garrett suffered serious injuries in the wreck. According to reports, EMS medics noticed the odor of alcohol on his breath. Investigators planned to subpoena his treatment records as part of a DWI investigation.

With a crash like this it doesn't seem all that surprising that police would test for alcohol consumption as a factor. Depending on what their blood tests reveal it may also be important to track down the source of that alcohol. Why? Because whoever sold or served it to the driver may be responsible for the damage he suffered at the wheel under dram shop law.

With that said, sometimes authorities mention intoxication as a possibility only for more thorough investigations to rule it out. Smelling alcohol on a driver's breath as medics supposedly did might only indicate that he had a drink or two, but not enough to affect his ability to drive or make him legally intoxicated. As for leaving the roadway that could just as easily have been caused by a slick spot in the road or a blown tire. The victim deserves the benefit of the doubt just like anyone else as more information is gathered. That's why it's so important that experienced investigators look into what really happened and nobody jumps to any conclusions in the meantime. Steps should always be taken to ensure victims and families have as much information as possible so they can get as much help as the law gives them the right to pursue.
