Commentary on Pedestrian Accident on Loop 375 in El Paso

Most folks would agree that crossing the main lanes of a highway, especially at night, is pretty darn dangerous. However, things aren't always as simple as just blaming the pedestrian and moving on. There can still be extenuating possible circumstances to consider.

For example, I had a family come to me a while back after their loved one died in a similar incident. When we looked into things, though, we found out the man was dangerously intoxicated at the time because a local establishment illegally over-served him. That meant the business was actually liable under dram shop law for contributing to the fatal incident.

Had people just blamed the victim and moved on, that reckless business likely would have faced no consequences for their actions. I'm not saying anything like that happened here, but that's why I say it's always prudent to make sure experienced professionals look into a serious accident.
