Commentary on Michael Scott Dolan Truck Accident in Wichita Falls
Crashes like this are pretty common, at least in the sense that someone slows down, and someone else fails to. That usually means that rear driver was following too closely, driving too fast, or driving while distracted. However, the detail about the box blocking the lane of travel can make things a bit complex. Would it really be a driver's fault for not slowing down in time if there was someone else whose actions caused the vehicles to stop in the first place?
Believe it or not, this is a big deal when it comes to helping people after a crash. The law is nuanced enough that multiple people can share responsibility for someone's injuries. A jury, for example, would hear the evidence and decide how to apportion the blame accordingly. Insurance companies use this as an opportunity to muddy the waters as much as possible. If they see that someone was blocking the road, for example, they could do everything in their power to minimize their own blame and put as much on the other guy as possible.
Now, would that happen here? Was the person in the road mostly responsible for this? Or, was it the drivers who couldn't seem to do what the victim had no problem doing by slowing down without incident? That's not for me to say, but hopefully it's clear that incidents like this are best in the hands of experienced professionals who can ensure the facts are as clear as possible.
