Commentary on Michael James Hutchinson 18-wheeler Accident in Harris County

Rear-end collisions like this typically come off as open-and-shut. That's because this is usually the result of distracted driving, speeding, or following too closely. It is possible, however unlikely, that something the truck driver had no control over led to the crash. I wouldn't suggest ignoring that. But beyond that, thorough investigations are still important even when something typical led to the crash. It's important victims and families have all the tools necessary to overcome potential roadblocks.

For example, someone came to me a while back with a crash where a semi rear-ended someone. It was clear the truck driver was distracted, but the company's defense team tried to say the truck driver didn't own a cell phone. I certainly wasn't buying that, but we needed evidence. Fortunately, we used our experience with similar situations to put the driver through a deposition, and he ultimately tripped over his own stories and admitted to owning a phone. With that, we got a court order for the records, and they clearly showed that the truck driver was busy watching pornography at the time of the crash.

I'm not saying anything like that happened here, but it took extensive investigations just to overcome that one blame-shifting tactic. These are the kinds of hurdles people need to be prepared for. Otherwise, they may find a crash like this to be far less open-and-shut than reports make it seem.
