Commentary on William Gigac Pedestrian Accident in Addison
Folks may think that the claim of the pedestrian being intoxicated would only serve to tell the story thoroughly. However, that can actually be a vital piece of evidence to explain what happened here and whether or not someone is responsible for the fatal accident. That may sound unusual, but I actually had a case not long ago which shows why this detail can be so important.
In that situation, a family came to us after their loved one had wandered onto a freeway where a car hit and killed him. Through our investigations, we found that the man had been drinking at a local bowling alley. Well, evidence showed that bowling alley illegally over-served the man while he was obviously intoxicated. Due to his drunkenness, he became disoriented trying to walk home, leading to the fatal accident.
Thanks to those findings, the family was able to hold that business accountable through dram shop law for their role in the fatal accident. This can be crucial not just for helping victims and families but also for ensuring those responsible for their hardships faced the appropriate consequences. I can't say if anything like that happened here, but it goes to show why accidents like this need to be taken seriously until those involved get all the facts.
