Commentary on Chad Cherry Load Shift Accident in Phelps
Some people may see that load shift reportedly caused the crash and assume that's all there is to this. That pretty much explains it all, right? Well, in my experience, this is often just the first step. Finding out why the load shifted can be absolutely crucial.
To be blunt, it's often partly the fault of the driver. Most load shifts can be prevented by a pre-trip check from a prudent truck driver. Did that happen here? If so, then this could be a situation where the issue that caused the shift was unusual or the cargo was such that the driver could only do so much to see this coming. One question to answers in these situations, then, is, "Who loaded the cargo?"
It's not always the same company transporting and loading a truck. I had a case not long ago where poorly loaded cargo caused a fatal crash, and our investigations found that a separate company from the trucker loaded that cargo improperly, meaning they had to be held responsible for that. Could it be that something similar happened here? At the very least, it warrants more thorough investigations.
