Commentary on Alleged Drunk Driving Accident at Clearwood in Houston
Unfortunately, there may be people who are pretty numb to seeing alleged drunk driving headlines come out of Houston. They seem to happen at least a few times a week. But it's important to take each one seriously, and that means more than just charging the driver. If it's true that alcohol contributed to the crash, steps must also be taken to find out where that alcohol came from.
Texas has what's called dram shop law. It basically says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. While officials in Harris County are sometimes more thorough in looking for these negligent establishments, there are still so many incidents like this that things can slip through the cracks. That's why it's often more prudent to make sure independent investigators look into things, and the same could be true here, as well.
