Commentary on Garbage Truck Crossover Accident on Wrightsboro Road

While it's not entirely clear what caused this crash, the vast majority of incidents like this happen due to a handful of common factors like speeding, distraction, fatigue, and medical emergencies. Of those common factors only one favors the truck driver, and that's medical emergency. The law says that trucking companies are liable for factors that are foreseeable, and medical emergencies are often unforeseeable. So when that causes a crash--and it does from time to time--then a trucking company might not be liable for the damages caused, no matter how severe.

But that's where things become challenging. A lot of people think police can just look at a crash site and tell whether or not something like that happened. That's usually not the case. It takes a thorough investigation by an experienced, well-equipped professional to ensure all subtle details have been looked into properly. Without that, trucking companies can come up with whatever explanation they want to excuse what happened. When victims and families wait too long to get a private investigator out to the scene, it only gives the trucking company's defense team that much more time to tilt the scales in their favor.

Again, there's no telling what exactly caused this wreck without a more thorough investigation. But when 3 of the most common 4 factors in a crossover accident put the trucking company at fault, the company is likely to take whatever steps it can to deny or deflect blame. Victims and families must be sure they have the tools and allied they need to keep the fight fair.
