Two Injured in Single-Vehicle Accident on Goehmann Lane in Gillespie County, TX

Gillespie County, TX -- January 13, 2022, two people sustained injuries due to an accident where their vehicle crashed off-road, possibly due to alcohol.

Emergency services were called to the scene at around 5:15 p.m. in the area of Goehmann Lane and US 290.

Investigators said that a 35-year-old woman was driving a Land Rover along northbound on Goehmann. The vehicle lost control, went off-road, and crashed through an embankment. This caused the vehicle to overturn.

A 64-year-old woman in the Land Rover sustained incapacitating injuries. The driver was said to have non-incapacitating injuries. Currently, police allege that the driver was under the influence of alcohol at the time. This and other factors are under investigation.

It's obviously serious anytime authorities bring up alcohol, though I don't bring this up to throw stones at the driver, as people typically do after reports like this. Me lecturing people about drunk driving isn't very productive, and if the allegations are true, that person will likely answer for their mistakes through our legal system. But all that wouldn't change the fact that people were hurt here, and there may be unique legal avenues to get them the help they need. Taking steps to make sure investigators are looking into those possibilities can be absolutely crucial, as can understanding what those steps may entail.

To put it simply, Texas dram shop law says that an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. A lot of accidents like this which do involve alcohol happen as someone is coming from a bar, restaurant, or similar establishment. If evidence shows that establishment broke the law and over-served someone who then got into a crash, why should they get to continue business as usual like they did nothing wrong? Why would anyone jump at the opportunity to blame a drunk driver without also recognizing a negligent alcohol provider over-serving them also played a role in getting people hurt?

Dram shop can help ensure those businesses are held accountable for their actions while also helping people to get some much needed help which may not otherwise be available to them. Am I saying that happened here? Not at all, and I wouldn't without any clear evidence. It's simply that reports like this can cause folks to jump to conclusions and narrow in on one or two details when getting help requires a broader perspective. Are steps being taken here to consider the possible avenues the victims and families can use to get some much needed assistance, or would that require efforts from more experienced professionals?
