Authorities say the incident happened shortly before 6:00 a.m. on US-90. Preliminary investigation suggests Bourg was driving a Chevrolet Cruze on the roadway when he collided with the back of a commercial 18-wheeler that reports say was "partially in" the left lane of the roadway.

Bourg, reportedly wearing a seat belt at the time, suffered fatal injuries in the collision. The truck driver was unhurt.

Commentary on Drew Bourg II Accident on US-90 in Raceland

When folks see a rear-end collision like this, they often write it off on the assumption that the victim did something wrong. It's true that many similar crashes are ultimately found to be the fault of the rear driver, but that's not always true.

Just the other day I looked into a crash where police learned an 18-wheeler pulled into the path of a car at night and its trailer's lights were off. In that situation is it really reasonable to blame the victim just because they hit the back of another vehicle? Of course not. I can't help but notice that news reports about the Raceland crash mention the big rig was "partially in" another lane on the road, which certainly needs further explanation. If the truck was straddling the lane divider or making an unsafe lane change when the victim approached, that would complicate matters and certainly might mean fault is a more complex matter than it may appear at first.

Because of the complexities often found in many crashes, the law is nuanced enough to examine the totality of the event instead of just placing blame automatically on one person or another. Will the investigating officials be as careful and thorough as is needed to make proper sense of what happened?
