Commentary on Jarvis Wayne Decuir Car Accident in Houston

I find that folks tend to overlook crashes like this without much thought. Police say that someone was under the influence of alcohol and got themselves hurt. What more is there to say? Well, first of all, it's important to take early reports like this with a grain of salt. For all we know, these reports are completely wrong, and factors besides alcohol actually caused the crash. But even if alcohol was a factor, the drivers are not always the only people who need to take responsibility.

Something not a lot of people know about is dram shop law. Essentially, if a bar over-serves someone, and that leads to them harming themselves or someone else, the bar can be liable for their role in the crash. Even if drivers may still face consequences of their own, Texas law gives them the right to get some much needed help and to see a business whose negligence caused them harm. Maybe nothing like that happened here, but it's one of the reasons folks shouldn't just condemn someone outright without knowing all the facts.
