Commentary on Alleged DWI Accident on FM 93 in Temple

With a situation like this, folks tend to overlook the crash. Police say someone was drunk and got themselves hurt. What's there to talk about? Well, according to Texas law, quite a bit. Whatever consequences a driver may face for a crash like this is between them and the authorities. Beyond that, they still deserve whatever help they can get. For accidents involving alcohol, that process can be unique due to dram shop law.

According to dram shop law, an alcohol provider who over-serves an obviously intoxicated person can be liable for damages resulting from that intoxication. Holding those businesses accountable is important not just for helping people but also for ensuring those businesses are held accountable so that they'll clean up their act. Maybe that isn't exactly what happened here, but I see no reason why these possibilities shouldn't at least be looked into.
