Jerimiah Tucker Injured in Pedestrian Accident in Denison, TX

Denison, TX -- January 5, 2022, Jerimiah Tucker was injured following an accident where a vehicle struck Tucker in the roadway.

Authorities reported that the collision took place at around 7:00 p.m. along FM 691. Police said that Jerimiah Tucker was allegedly intoxicated at the time of the accident. Reports said Tucker was lying in the roadway when a vehicle hit him.

Tucker went to an area hospital with reportedly critical injuries. Police say that Tucker will face intoxication-related charges.

These are some concerning details, and I find that folks are quick to write off reports like this. They just shake their heads and walk away seeing the victim as being irresponsible. But when alcohol contributes to an accident like this, folks need to understand that it's not always the intoxicated person that contributed to the accident.

Let me give an example of why accidents like this can be so complex. I had a case a while back in which a man died while walking home from a bar. The evidence showed that the man became highly intoxicated at the establishment, but the servers kept selling drinks. In Texas, it's illegal to over-serve someone who is obviously intoxicated and a clear danger to themselves and others.

He died as a result. Because the evidence showed that alcohol caused the man's death and because that alcohol was the result of a bar negligently over-serving him, that bar was liable for their role in the man's fatal accident under dram shop law.

Now, am I saying that happened here? Not at all. I wouldn't be able to say what did or didn't happen here without more evidence. My point is simply that Texas law is a lot more nuanced than people realize. When you reserve your judgments, avoid jumping to conclusions, and instead focus on how to get people the help they need, it tends to work out better for the victims, their families, and the community as a whole. It remains to be seen, then, if this accident will get the attention it deserves.
