On Saturday April 10 Amanda Payton died after being involved in a car crash in Mt. Vernon Township IL.  According to police Payton an 18-year-old high school senior was riding in a vehicle driven by another person when the incident occurred.  The driver allegedly crashed on Davis Road but the exact cause of the incident is still under investigation.  Somehow Payton became trapped underneath the vehicle.  She was pronounced dead at the scene.  The driver was taken to nearby hospital.  No charges have yet been filed but the investigation is ongoing.

Losing someone you love in a fatal incident like this is a devastating experience. As investigators examine this incident they may find that the victim died due to another persons negligence (in cases where a passenger is killed in a wreck the vehicle’s driver is sometimes held liable for the victim’s death).  In such an event the victims family may attempt to file a wrongful death lawsuit.  Unfortunately this is almost never a simple task.  I have worked on cases like these for twenty years and in my experience people may go to great lengths to avoid being found responsible for this type of incident.  In truth however the law is designed to protect the victims and their families in these situations.  With a legal professional with wrongful death experience helping you build a solid case you can make sure that those responsible for the death of your loved one are held accountable for their negligence.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
