On Saturday, February 27, Jennifer Sztukowski was killed in an auto accident in Milwaukee. Sztukowski was riding as a passenger in an SUV driven by Joshua Lechmaier. Lechmaier admitted to drinking four beers before leaving. Police report that Lechmaier had a blood-alcohol level of twice the legal limit, and he was driving erratically at 90 miles per hour. He has been charged with intoxicated homicide.
Drivers have an obligation to ensure that they do not negligently endanger the lives of others, and this obligation extends to their own passengers. In cases where a passenger is killed due to the negligence of the driver, family members may wish to sue those responsible for wrongful death. Unfortunately, this is never a simple task. I have worked on these cases for twenty years, and in my experience, people will do almost anything to avoid being held responsible for this kind of accident. But the truth is that the law is on your side, and with the help of a wrongful death attorney, you can make sure that the people responsible for your loved one's death are brought to justice.
