Four dead after Toyota Avalon drove into pond. Possible accellerator malfunction.
A Saturday morning accident has left four people dead. Monty Hardy was driving 3 others in a 2008 Toyota Avalon through Southlake, TX, when the vehicle veered off a road, flipped and landed upside down in a pond. The 2008 Toyota Avalon had just been recalled last month over concerns of the accelerator getting stuck to the floor mat, causing uncontrollable acceleration. No skid marks were found on the road, and police say it will be difficult to determine the exact cause of the fatal accident. The vehicle occupants, 35-year-old Hadassah Vance, 38-year-old Wendy Akion, 56-year-old Monty Hardy, and 56-year-old Sharon Ransom, were all pronounced dead at Baylor Regional Medical Center at Grapevine.
If investigators find evidence of the gas pedal getting stuck on the floor mat, then the manufacturer of the vehicle (Toyota) is liable for any injury or death caused by that defect. You can be sure that Toyota will do everything it can, to show that they are not at fault in the accident. If they are shown to be liable, they will likely attempt to offer you an inadequate settlement.
