On December 20, 2009, 24-year-old Monica Berumen and 24-year-old Bernardo Castillo were involved in a car accident that claimed both of their lives. The fatal accident occurred as the two were riding in the rear seat of a Chevrolet Cobalt whose driver allegedly failed to yield the right of way to an 18-wheeler that was traveling in the southeast direction on Slanton Highway in Lubbock. Castillo died at the scene and Berumen died the following day. Authorities do not suspect that the 18-wheeler driver was at fault in the accident.
Naturally, the families of the victims would be able to file a wrongful death suit against the driver of the car. The problem with cases such as this is that there is typically a limited supply of funds from which to pursue a claim. If, however, it was determined that the reason the driver failed to yield the right of way was because a bar served him too much alcohol or because there was no yield sign in place, there would be other possible defendants. While scenarios such as this are a bit of a long shot, I always recommend to families that they conduct an investigation just to make sure.
