Passenger Christopher Fountain Killed Riding with Suspected Drunk Driver in San Antonio, Texas
According to the San Antonio Express-News, a man was killed in a
single-vehicle accident in San Antonio, Texas where the driver is
alleged to have been intoxicated. The wreck occurred early Saturday,
February 18 when police believe 40-year-old Ernest Fountain Jr. was
intoxicated and struck a utility pole on Texas 16. His passenger,
36-year-old Christopher Fountain, believed to be the man's brother, was
killed in the accident. Fountain Jr. has been charged with intoxication
manslaughter.

Commentary While driving under the influence is certainly a terrible
act, I'm not interested in discussing a brother's wrongful death claim
against another. Rather, I'd like to talk about another party who could
be liable in the accident. First, the allegations of intoxication would
need to be concretely established and then a third party investigation
would need to determine where the imbibing occurred. If this took place
at a bar or restaurant, their compliance with TABC guidelines would need
to be determined, as it is illegal and indeed actionable civilly to
serve an obviously intoxicated patron. When a bar or restaurant chooses
to forgo these rules and continue service, they not only put the patron
in danger, but also other motorists should they get behind the wheel. To
uncover contingencies like non-compliance to alcohol-serving rules, a
thorough period of discovery would need to occur, but could mean both
the decedent and the injured driver may have a dram shop claim against
the bar or restaurant.
