Kylie Doniak Critically Injured by Suspected Drunken Driver in Austin, Texas
According to KXAN, a woman was critically injured in a pedestrian accident with a suspected drunken driver in Austin, Texas. The wreck occurred early morning Friday, February 3 when Austin police believe 22-year-old Nicholas Colunga ran a red light on San Jacinto and struck 22-year-old Kylie Doniak. Witnesses to the accident state the driver did not slow down or stop, but was later detained by a civilian until the police arrived. Colunga has been charged with intoxication assault and failure to stop and render aid.

Commentary This is a very persistent problem in downtown Austin, especially around closing time for bars in the area. Certainly most realize the alleged drunken driver could incur serious liability in the accident, but my firm utilizes vendor liability laws in place to make sure the initial cause of these accidents are addressed too. In fact, we were recently hired to investigate the alcohol intake of a driver who drove intoxicated and killed their passenger. The investigation found multiple bars on 6th street visited and imbibed at, as well as bartenders who openly admitted to not stopping service to the impaired duo. For those who do not know, it is illegal to serve alcohol to an obviously intoxicated patron in Texas. When a bar or restaurant decides to forgo the guidelines established by the TABC, the very entity that licenses these places, they open themselves up to vendor liability laws, called dram shop laws. They were put in place to address bars and restaurants like the ones we found, and hold them partially liable for a drunken driving accident. Readers should note the use of the word partial, as fault will be shared between the driver and the business, if they are found to be non-compliant.
