Commentary Hit-and-run accidents are particularly frustrating, as good evidence is not preserved because a driver failed to stop at the scene of an accident, and closure is difficult to obtain by the victim's family. Regarding this accident, once the third driver is found, an independent investigation should depose all witnesses and attempt to determine the relationship between the pedestrian's position on the roadway and the vehicles in question. If say, driver inattention caused one of the driver's to veer into the shoulder of the roadway, civil strategies could exist for survivors of the victim. This is only speculation, of course, until more details are released and the investigation can dig into the accident.
