Eric Beck Killed in Collision with Suspected Intoxicated Driver in Bristol, Pennsylvania
According to Philly.com, a male pedestrian was killed in an accident
with an alleged intoxicated driver in Bristol, Pennsylvania. The wreck
occurred early Sunday morning, February 19 when police believe
23-year-old Charles Horrocks illegally tried to pass a vehicle on the
right and struck a pedestrian at a high rate of speed. 36-year-old Eric
Beck was killed when he was struck by the vehicle traveling at an
estimated 60 miles per hour.
Commentary Until an
intoxication screen comes back positive, the alcohol link is indeed an
allegation. However, if the man was "wasted' as one news feed quotes, he
and another party could face severe liability in the accident. First
regarding the driver, even without the alcohol allegation, the act of
using excessive speed and making an illegal pass on the roadway are
probably contrary to what a rational person may expect. This contrarian
act could be what forms the basis of a wrongful death claim, as
negligence must be proven by a plaintiff to the claim.
Regarding a third party's liability in the accident,
Pennsylvania has vendor liability laws that make it an illegal act to
serve a patron who is visibly intoxicated. Workers at alcohol-serving
entities are trained to identify this inebriated state and subsequently
stop service. When they fail to do so, lives are put at risk, including
that of the patron. These laws make this act a negligent offense and
could make a bar or restaurant party to a wrongful death suit.
