Larry Sternberg Killed While in the Custody of the Fort Worth Police Department
According to WFAA, a man was beaten to death while in custody at a Fort Worth jail. 45-year-old Larry Sternberg died February 14 after he was beaten and kicked by another inmate at a law enforcement holding tank. Police are investigating their review of holding inmates. Records indicate Sternberg was arrested on January 6 for suspicion of public intoxication.
Commentary
The news feed accurately notes the custodial relationship of the Fort Worth Police Department with the inmate. Because of the nature of jail, an inmate's safety is directly attributable to the actions of those who run the corrections unit. If guards failed or were late to respond to the incident, this could constitute negligence and be an actionable entity in a civil motion. It is important to note, however, that city and state entities enjoy certain privileges and immunities that citizens do not, and in some instances where a civil case is allowed to continue, also enjoy caps on damages.
