Pedestrian Ronnie Brice Killed by Alleged Drunken Driver in Fort Worth, Texas
According to CBS DFW, a pedestrian was killed by a suspected drunken
driver in Fort Worth, Texas. The incident occurred around 2:35 a.m.
Saturday, February 18 when 28-year-old Brian Jason Hopkins was traveling
westbound on Calmont Avenue when he heard something hit his vehicle.
56-year-old Ronnie Brice was struck by the car, sending him several feet
from the point of collision. He was pronounced dead at the scene.
Hopkins has been charged with intoxication manslaughter.
Commentary If the
allegations of intoxication prove to be true, not only could the driver
face serious liability in the accident, but it is possible another party
could as well. This type of information, however, is typically only
uncovered with an investigation that can work in collaboration with the
police reports, as these contingencies are typically not checked on by
the police. Everyone knows the dangers of drunken driving, but the
dangers of over-service are less apparent. Due to the severity of the
latter, Texas developed laws called dram shop laws, which could hold a
bar or restaurant liable if they were found to serve an already
intoxicated patron. To be legally licensed to serve alcohol, staff,
bartenders, and managers are trained to identify this state of
intoxication and subsequently deny service. When an entity fails to do
so, they not only put the intoxicated patron in danger, but also other
motorists, should they get behind the wheel of a vehicle.
