Maria Lankford Killed in Pedestrian Hit-and-Run Accident in San Antonio, Texas
According to the San Antonio Express-News, a woman was killed in a
hit-and-run accident in San Antonio, Texas. The incident occurred 10:30
p.m. Friday, February 10 when 37-year-old Maria Lankford and her son,
17-year-old Jeanpaul Lankford were walking home on Westfall Avenue. A
driver in an SUV struck the woman, injuring her critically at the scene.
Her son was able to dive out of the way and was uninjured. Maria
Lankford was taken to University Hospital where she passed away Sunday,
February 12. The driver of the dark-colored SUV, possibly a Jeep Grand
Cherokee, fled the scene and has not been found.
Commentary This is
inexcusable. I hope the driver of the SUV is found and justice is
served. The son, who witnessed the accident, has stated he believes the
vehicle intentionally tried to hit the two. While I cannot comment on
this, regardless of that assertion, I can say that this is a
particularly frustrating accident. Not only is a family not allowed any
closure, but key evidence which could be valuable in both criminal and
civil proceedings may be destroyed. In the past, hit-and-run accidents
that my firm has litigated produced a driver who was fleeing for reasons
other than just a pedestrian incident. Issues like intoxication or
possession are just a few examples that could be covered up because of
this person's flight. When the driver is caught (and I do have
faith in the police), an investigation should inspect their vehicle to
shore up liability. If the reports are accurate and the SUV veered onto
the shoulder, they may incur serious fault from the accident and in
turn, open themselves for a wrongful death suit. This is a very
fact-dependent possibility, as a plaintiff must prove negligence before a
claim can proceed. If successful, a claim can compensate areas like
funeral arrangements, pain and suffering, loss of consortium, or loss of
financial support the victim provided.
