Joseph William Bardwell and Michael Don Lloyd Killed in Pedestrian Accident in Weatherford, Texas
According to the Fort Worth Star-Telegram, two men were killed by a
vehicle, following a physical disturbance in a roadway in Weatherford,
Texas. The accident occurred around 8:25 p.m. when 35-year-old Joseph
William Bardwell and 20-year-old Michael Don Lloyd were involved in an
altercation in or near the roadway of Santa Fe Drive. A vehicle passing
by struck both men, killing each at the scene. Weatherford police
continue to investigate the accident.
Commentary From a
legal standpoint, this is an interesting accident, though I do not want
to make light of two lives being lost in this tragedy. Legally speaking,
this accident probably falls into the category of comparative fault. In
other words, the police investigation being conducted now (and indeed
it is often useful to have a third party inspect the accident scene)
will determine what potential civil strategies exist moving forward, by
comparing the actions of the two decedents with that of the driver.
Comparative fault exists as a means to quantify the
contribution multiple parties had in an accident. The note in the
article that the men were either on or near the road is particularly
relevant, as one of the chief jobs for both investigations will be to
accurately identify the position of both victims and the driver of the
vehicle. This and other contingencies will determine the level of fault
each party provided, which will then help to explain if a remedy is
available.
