Jisia Bell and Jhi Bell Killed in Accident Along State Highway 29 in Georgetown, Texas
According to KXAN, 2 children were killed and 3 other people injured in a
car accident in Georgetown, Texas. The accident occurred around 3 p.m.
Tuesday, February 14 when a Honda sedan with 5 occupants was stopped in
the eastbound lanes of SH 29 to make a left turn. The sedan was then
struck from behind by a Jeep Grand Cherokee. 1-year-old Jisia Bell and
4-year-old Jhi Bell were killed in the accident, while their mother,
19-year-old Catrice Bell and two others were taken to a nearby hospital
with injuries.
Commentary These
highways that do not have a dedicated left turn lane are particularly
dangerous for motorists. Even so, a driver turning left from the highway
should still have a reasonable expectation towards their own safety
when doing so. Motorists behind the turning vehicle must be attentive
and recognize the need to stop their own car. Perhaps proper attention
was not granted here. To begin to deconstruct this terrible accident, a
third party investigation should be used to shore up liability. This
will help in defining civil strategies moving forward for victims or
their survivors. To have standing in a wrongful death claim,
this expectation I mentioned before has relevancy. You see, a claim must
be able to show negligence to proceed. Negligence is determined by
essentially pairing a liable party's actions with a reasonable person's
expectations at the time of the accident. Again, it comes down to
whether it is reasonable for a person to expect to be safe while waiting
to make a left turn from the highway. Once this is proven, a claim need
only to be filed by survivors who are eligible under Texas laws to do
so on a victim's behalf, and these survivors must be able to show a
tangible economic loss from the incident.
