Felipe Lozano Killed in Head-On Crash in Conroe, Texas
Local reports from the Montgomery County Police Reporter indicate a man
was killed in a head-on collision in Conroe, Texas. The accident
occurred around 10:10 a.m. Saturday, February 11 when 55-year-old Felipe
Lozano was traveling westbound along SH 105. According to witnesses,
28-year-old Vicente Padilla failed to yield right of way to Lozano and
struck the car head-on. Lozano was pronounced dead at the scene, while
Padilla's passenger, 29-year-old Wendy Palmertree was taken to Conroe
Regional Hospital in stable condition.
Commentary Failure
to yield is one of the chief violations of a duty on the roadway. This
duty is defined by operation of a motor vehicle, in accordance with what
a reasonable person may expect. Actions like failing to yield the right
of way, driving with excessive speed, failing to signal a turn, or
inattention are just a few of the ways these duties are broken daily.
The issue becomes, however, when a driver fails to adhere to one of
these duties and then causes an accident, their breach could become an
actionable offense. This action forms the basis of a wrongful death
claim, as a plaintiff must prove that the liable party in question was
negligent in their behavior, at the time of the accident. A wrongful
death claim is founded on a determination of negligence, but must be
supplied with survivors of the victim who the state of Texas recognizes
as able to file on the victim's behalf. A successful claim can aid in
compensating a victim's survivors in areas like funeral arrangements,
loss of consortium, or loss of financial support the victim provided
before their death.
