Raul Perez Jr. Killed Attempting to Help Stranded Motorist in Clyde, Texas
According to the Abilene Reporter-News, a man was killed attempting to
help a stranded motorist in Clyde, Texas. The accident occurred around
6:45 p.m. Sunday, February 12 when 33-year-old Raul C. Perez Jr. pulled
his 18-wheeler off the roadway and tried to check on a vehicle that was
just involved in an accident. As Perez went back to his truck, a woman
struck the disabled vehicle and then hit Perez. He was taken to Hendrick
Medical Center where he later passed away.
Commentary Unfortunately, one commenter got it right, had this man not
done his civic duty and tried to help accident victims, he may still be
alive today. My hope is that this incident and others does not
discourage folks from taking care of stranded or injured motorists, but
rather encourage oncoming motorists approaching an accident scene to
take extra caution. I mentioned in another blog that a person should
feel reasonably safe with their vehicle on the shoulder of a roadway,
and I believe that is relevant here as well. This feeling, if
you will, is actually codified in law as a duty of care that, like it or
not, drivers owe other drivers on the roadway. Certainly there are
exceptions, but this duty is most commonly manifested in areas like
driving safely, paying attention on the roadway, adhering to the posted
speed limits, etc. When a driver fails to undertake one of these duties,
they are in breach of their obligations on the roadway, and as such
produce a cause of action for a plaintiff. This is an important function
of personal injury law, as a plaintiff must adequately prove when and
how this breach occurred. Once it is proven, a wrongful death claim
typically has standing, as long as a victim has eligible survivors
(eligible meaning states allow different relatives or dependents to
bring a claim) who can file on their behalf, and these survivors must be
able to show a loss of finances due to the accident.
