Jonathon McRae Killed in Incident at Store Parking Lot near Leagueville, Texas
According to the Tyler Morning Telegraph, a man was killed in a hit-and-run accident near Leagueville, Texas. The accident occurred around 9 p.m. Thursday, February 9 when Henderson County Sheriff's officials believe 19-year-old Jonathon McRae and 17-year-olld John Forester were involved in an argument in a store parking lot. McRae grabbed Forester's truck, and Forester drove away, dragging McRae for several feet and then running him over. McRae was pronounced dead at the scene.
Commentary Normally in my blogs, I write about accidents that I read about in the news, and discuss how they play out on the civil side of the law. Without many details it is difficult to speak to an effect of this accident. I can say that in personal injury law, successful cases come down to proving a breach of duty, or negligence. In just about any situation, parties (where unbeknownst or not) owe other parties a standard of care. Think of the motorist next to you on the roadway, who you must trust does not veer into your lane when you take that turn up ahead. In some capacity, you are trusting that they abide by their legally-given duty of safe operation of a motor vehicle. This same duty applies in other situations, and could very well apply in this parking lot. Would it be reasonable to assume the driver of the truck could have predicted injury had he drove away? Conversely, was he driving away to avoid a threat? These are issues for police reports and separate investigations, but they do speak to how a liability determination is made. With that determination, strategies towards compensating an accident can start to develop.
