Sherron Price Killed, One Injured in One-Car Accident along LBJ Freeway in Dallas, Texas
Reports from the Dallas Morning News indicate a woman was killed and a man injured in a one-vehicle accident in Dallas, Texas. The wreck occurred around 3:30 a.m. Sunday, February 12 when a male driver on LBJ Freeway lost control of his vehicle, causing it to flip. He was ejected from the car, while his female passenger was killed in the accident. The driver was taken to Baylor University Medical Center in Dallas, Texas in critical condition. Dallas police state alcohol was found in the vehicle, but have not determined if it was a factor in the accident.
Update: The passenger has been identified as 36-year-old Sherron Price.
Commentary Until more details are given regarding the incident, it would be difficult to speculate on any potential outcomes on the civil side of the law. I can definitively say that the prospective link to alcohol in the vehicle will go a long way in determining the after effects. You see, when a person chooses to drink and drive, they not only put themselves in danger, but also their passengers, and of course other motorists. Obviously the news feed does not speak to this yet, but if the driver were found to be intoxicated, or at the very least imbibing while driving, that could be an actionable cause, civilly. I say this because to have standing in a wrongful death claim (in other words, survivors of the victim having a cause of action against the driver of the vehicle), negligence must be found. Negligence is an objective action, typically classified as allowing one's actions to fall below a standard of care which a reasonable person would expect at the time of the accident. This is manifested in a number of events, like driver inattention, errant driving, using excessive speed, or alcohol usage. When negligence is found, typically a wrongful death claim has standing and can proceed if a victim has eligible survivors to file on their behalf.
