Misael Gomez Killed in Single-Vehicle Accident in Grand Prairie, Texas
According to the Dallas Morning News, a man was killed in a one-car
accident in Grand Prairie, Texas. The incident occurred around 11:10
p.m. Sunday, February 12 when Grand Prairie police believe 33-year-old
Misael Gomez was traveling west on Interstate 30 when his vehicle veered
into the right shoulder, hit a warning sign, and struck a parked
Suburban on the shoulder. Gomez was taken Methodist Dallas Medical
Center where he was later pronounced dead. Police are waiting for
toxicology reports before they rule on a cause of death, but do believe
alcohol may be a factor in the crash.
Commentary The news
report does not give much in the way of details in this accident, other
than the prospective alleged link to alcohol. Because of this gray
area, a third party investigation should be used in conjunction with the
police reports, to determine a cause as well as make apparent any
potential civil remedies available. As far as I see the accident,
survivors of the victim would have only two possible causes of action
for restitution, provided a select set of facts are found at the
accident scene. First and foremost, the vehicle in question
should be inspected for any defects. If a component failed on the pickup
which caused the driver to lose control, there could be the chance of a
claim against a manufacturer. This would require carefully proving that
the faulty part was the proximate cause of the accident, and requires
hours of detail into the machine. Interestingly enough, the
alleged alcohol intake could provide a strategy towards restitution if a
few scenarios were present. Certainly first, police reports would need
to confirm that the driver was indeed intoxicated at the time of the
accident. Then, the investigation would be tasked with tracing the
driver's whereabouts before the incident, to see if imbibing occurred at
a bar or restaurant. If it did, the next task would be to gain an
understanding of the entity's safety measures, especially in regards to
an intoxicated patron.
