Jimmy Lloyd Sanderson Killed, Adam Espinosa Injured in One-Car Accident near Madill, Oklahoma
Reports from News On 6 indicate one man was killed and another was
critically injured in a single-vehicle accident near Madill, Oklahoma.
The accident occurred around 10:15 p.m. Saturday, February 11 when
40-year-old Jimmy Lloyd Sanderson was northbound on U.S. 377 when his
truck veered on the roadway, struck a curb, then ran off the roadway and
struck numerous trees. Sanderson was killed at the scene, while his
passenger, 32-year-old Adam Espinosa was critically injured from the
accident. Espinosa was taken to Parkland Hospital in Dallas, Texas, with
head, trunk external and internal, arm, and leg injuries. The Oklahoma
Highway Patrol continue to investigate the accident.
Commentary One-car
accidents are particularly difficult to deconstruct, as their cause may
not have any witnesses, or be apparent at the scene. Due to this, an
independent investigation into the accident should be conducted, with
emphasis on inspecting the vehicle in question for defects. My firm has
litigated a number of accidents in the past that were not actually the
fault of an errant or inattentive driver, but rather because some key
component on the vehicle failed. If the investigation found this to be
the cause, both the driver and passenger would have a claim against the
manufacturer. Speaking more to component failure, in some instances in
the past, we've seen an accident caused by a service station failing to
fully repair a vehicle, such that their liability was incurred by
allowing an unsafe vehicle to return to the roadway. Of course
on the other hand, if the investigation comes back with findings that
suggest the driver undertook actions that were not within the realm of
safe vehicular operation, they could be at fault in the accident. This
would require proving that the driver made a maneuver (or several) that a
normally prudent individual would deem unsafe. If this were found, the
passenger of the vehicle may have a claim against the driver, for their
injuries sustained.
