Linda Vela Killed by Vehicle while Waiting for School Bus in La Vernia, Texas
According to the San Antonio Express-News, a high school student was
killed waiting for her school bus near La Vernia, Texas. The accident
occurred Friday morning, February 10 when 16-year-old Linda Vela was
waiting for the school bus along FM 1346. She was struck and killed by
an unidentified vehicle. Texas Department of Public Safety officials
continue to investigate the accident.
Commentary As of
right now, there are no details available other than the victim's name
and area of the accident. Often times, accidents have no witnesses and a
victim or their survivors must rely on police reports to determine a
cause. In most fatal situations, but especially ones that lack solid
details, a third party investigation should be used to corroborate with
the police findings. To have a chance at being compensated in an
accident, a plaintiff must provide concrete proof of the liability of
the defendant. This proof is needed because a victim or their
survivors must prove that the defendant's actions at the time of the
accident were negligent. Negligence essentially means that a defendant
allowed their actions to fall below what a reasonably prudent person
would expect. This is usually manifested in the form of an unsafe
maneuver, excessive speed, or perhaps inattention on the roadway.
Whatever the case may be, proving this key area is probably the most
significant part of a wrongful death claim, and will factor into whether
or not restitution is available.

We will miss her :( It is so tough seeing her one day and her not being with us the next. It hurts knowing how much of a good kid she was. She was nice to everyone and did almost everything. I cried so much and did not believe it. She wasn't my closest friend but an empty desk in the classroom just doesnt feel right. I will miss her and her family is in my prayers.
