Amanda Louise Dewey Struck and Killed by CapMetro Bus in Austin, Texas
According to KXAN, a woman was killed in a pedestrian accident with a
Capital Metro bus in Austin, Texas. The incident occurred around 6:30
p.m. Monday, January 30 when 53-year-old Amanda Louise Dewey was
crossing Jollyville Road at Braker. Police reports and video from the
bus show the vehicle turning onto Braker Lane in wet conditions. Both
the bus and Dewey had a green light, but investigators say the
pedestrian had the right of way. Dewey passed away Tuesday, February 7
due to the injuries sustained in the accident.
Commentary This is a very unfortunate accident and one of the flaws in
the pedestrian system. Give pedestrians a dedicated crossing light and
slow these accidents down. Regarding this incident, when a pedestrian
has a green light or a walk sign, and they are legally within the
allotted crosswalk area, they have the right of way to all traffic. Some
reports like this one note the rainy conditions, but frankly that does
not mean much. With the police reports and video from the bus dash cam,
there may be enough to have standing for a wrongful death claim. The
question for a separate investigation becomes the detailing of the
relationship between the the bus company, their contractors, and the
city. While this is certainly more rare, in some accidents,
liability is not much of a disputed issue. Like in this incident, the
issue is who is liable for this woman's injuries. Certainly the actual
bus driver would incur some liability, but what about the busing
company? Conversely, was this actual bus part of a contracted fleet from
CapMetro like some reports suggest? And then, what is the city of
Austin's involvement with the fleet of buses? I mention this contingency
because I know some of the surrounding communities like Cedar Park,
Lago Vista, and Pfugerville opted into this service in 1985. This is
noteworthy, because state-run programs enjoy certain privileges and
limitations (caps on damages) when it comes to personal injury
claims.
