Pickup Truck Driver Killed After SUV Rear-Ends at Speeds Approaching 120mph in Waco, Texas
Several news sources report a man was killed by a vehicle traveling at
high-speeds in Waco, Texas. The accident occurred Friday morning,
February 3 when Waco police believe 28-year-old Miranda Monique Campbell
was driving her SUV at speeds reaching 120 miles per hour. At the
corner of 36th and Waco Drive, she crashed into the rear of a Ford
ranger pickup, causing the truck to rollover and ignite. The pickup
truck driver was killed at the scene and will be identified, pending
notification of his family.
Commentary If the
reports are accurate and the vehicle that struck the man's pickup was
traveling at speeds above 120mph, this is an egregious usurpation of
driver duty on the roadway. Duty is part of the process in defining a
wrongful death cause of action. A plaintiff must prove that another
party owed them a standard of care before an accident, and that this
standard was broken by the other party's actions or inaction. To
determine the exact rate of speed at impact, a third party investigation
would be useful, but with speeds passing the triple-digit mark, this is
probably a clear breach of driver responsibility. If a jury rules this
breach to be an act of negligence on behalf of the defendant, a wrongful
death claim typically has standing. If a claim is successful,
a victim or their survivors could seek damages in areas like funeral
arrangements, pain and suffering, loss of consortium, or loss of
financial support the victim provided before the accident.
