One Man Killed, Female Passenger Critically Injured in Single-Vehicle Accident in Fort Worth, Texas
According to the Dallas Morning News, a man was killed and a woman
seriously injured in a one-car accident in Fort Worth, Texas. The
incident occurred around 2:30 a.m. Tuesday, February 7 when the car
slammed into a pillar under Interstate 35W. The car caught fire, killing
the male driver inside. His female passenger was either ejected from
the vehicle or managed to escape and was taken to John Peter Smith
Hospital where her condition was unknown.
Commentary It is
very difficult to determine a cause from the accident given the
corresponding details. I do hope the female passenger turns out to be
alright. Because details are going to be difficult to discover, even
with a police investigation, a third party should inspect the accident
scene and the vehicle in question for liability purposes. This
inspection will go a long way in determining if strategies exist moving
forward. The way a one-car accident typically works is that
there are normally two possible scenarios following the wreck. The first
is a manufacturing claim, essentially asserting that something failed
on the vehicle, such that this failure was the proximate cause of the
accident. This type of claim is very detail dependent and requires an
investigation to pin a victim's injuries to that of the defect. Defense
attorneys are particularly well suited to shift fault from their
client's product to that of another, or conversely, highlight
preexisting injuries to mitigate some of the current ones. The
other scenario is a claim against the driver of the vehicle, provided a
few details are present. To have a personal injury claim, a plaintiff
must prove that a defendant's actions fell below what a reasonably
prudent person may expect. This expectation is the duty that every
driver owes to himself, his passengers, and other motorists on the
roadway. If this duty is breached by errant driving, inattention,
drinking and driving, etc., there is possible liability, which
translates into standing civilly.
