Pedestrian Woman Killed by Tow Truck near Strake Jesuit in Houston, Texas
According to the Houston Chronicle, a woman was killed by a tow truck in
southwest Houston, Texas. The accident occurred around 3 p.m. Monday,
February 6 when the 73-year-old woman was struck by a tow truck leaving a
shopping center on Bellaire Boulevard. The woman was dragged along a
driveway until parents from nearby Strake Jesuit High School yelled for
him to stop. The unidentified victim was taken to Memorial Hermann
Southwest Hospital where she was later pronounced dead. The accident
remains under investigation.
Commentary Very few
details have been given regarding this tragic accident. Issues like
positioning of both the woman and the tow truck, rate of speed, and the
pending blood test of the tow truck driver will come to define the
possibility of seeking restitution in a civil claim. Because this
accident resulted in fatal injuries, a third party investigation should
be used in conjunction with the police report, as liability is always a
contentious matter, especially involving a commercial vehicle. The combating
liability I mentioned comes from the fact that fault is often shared
between more than one party in an accident. In other words, the
contingencies that I mentioned earlier severely factor into prospective
compensation. Pedestrian accidents are particularly tricky as they
usually take place in areas other than crosswalks. Other the other hand,
even if the accident occurred at an area of the roadway that was not a
crosswalk, in most instances a pedestrian still has a reasonable
expectation towards safety. The question for a plaintiff, and
subsequently a jury, becomes how much of an expectation do they have?
This is the sharing of fault that I spoke to and can incredibly
influence standing in a wrongful death claim.
