Becky Fisk Critically Injured in Auto Accident in Conroe, Texas
According to the Montgomery County Police Reporter, a man was killed and
a woman seriously injured in an auto accident in Conroe, Texas. The
wreck occurred around 4:45 p.m. Monday, February 6 when police believe
40-year-old Jason Boatright took the turn on South Loop 336 at speeds
approaching 80 mph. He veered into the center of the roadway and lost
control, striking an oncoming Chevy SUV. 35-year-old Becky Fisk became
trapped in her SUV, along with her 13-year-old son. They were both taken
to Hermann Hospital in the Woodlands with what are thought to be
critical injuries. Boatright was pronounced dead at the scene.
Commentary I see
and read about so many accidents that more than likely could have been
prevented if a driver would just slow down. If the reports are accurate
and the driver of the smaller car took the turn at an excessive rate of
speed, they could face liability issues in a civil claim. It should be
noted however, that even with a favorable police report, a victim or
plaintiff still bears the burden of proof in seeking compensation,
raising the value of a third party investigation. To
successfully seek compensation in an auto accident, a plaintiff must
prove that the defendant owed them a standard of care at the time of the
incident, and then breached that care. Though a jury may ultimately
decide, excessive speed around a bend on the highway could signal a
breach of care. After extolling that breach, a plaintiff must provide an
accurate detail of damages incurred. This should reflect not only the
cost incurred from the time of the accident, but also costs like
rehabilitation, future medical bills, or wages lost.
