Claudio Cardenas Killed in Single-Vehicle Accident in Chicago, Illinois
According to WGN, a man was killed in a single-vehicle accident in
Chicago, Illinois. The incident occurred around 5 a.m. Saturday,
February 4 when 24-year-old Claude Harris lost control of his vehicle on
North Laramine Avenue. 34-year-old Claudio Cardenas was in the back
seat of Harris' vehicle, with his head out the window attempting to
vomit. As Harris looked back to check on Cardenas, he struck two parked
cars. Cardenas died due to blunt head trauma. Harris received citations
for driving under the influence, failure to keep in a lane, striking
unattended vehicles and trying to pass another car on the left.
Commentary Drinking
and driving is a huge problem throughout our nation. Until a toxicology
screen comes back positive on the driver however, driving under the
influence is only an allegation, but could define great fault in the
accident. Most are aware that in civil law, an accident that results in a
fatality could provide standing for a wrongful death lawsuit. However,
when alcohol is suspected to be involved, there could be other liable
parties beyond that of the driver. The state of Illinois has
certain laws, called dram shop laws, that could include a bar or
restaurant in a wrongful death claim, provided certain criteria is met.
Most notably from this list, is that an investigation must rule that the
sale of alcohol to the plaintiff was the proximate cause of
intoxication, and this intoxication was the cause of at least one of the
plaintiff's damages. Put another way, if patrons were over-served
alcohol, such that their intoxication presented a clear and present
danger to themselves and others, a bar or restaurant could be partially
liable in the accident. The claim would need to prove that the bar
should have recognized this danger and subsequently stopped service. It
is unfortunate, but it usually does not happen this way. You see, bars
and restaurants are for-profit entities, and patrons who have imbibed a
bit are more likely to continue spending. This relationship is precisely
why many states have enacted these dram shop laws, as there must be
some recourse to combat this dangerous behavior. The liability an
alcohol-serving entity could assume will only be partial though, as at
the end of the day, they were not behind the wheel of the vehicle.
